Terms and definitions:

The terms are used to determine rights and obligations of the consumer, and the services, rights and responsibilities of the entrepreneur.

When using and/or purchasing through Gewoon JIP., you agree to these terms and conditions.

Entrepreneur: the natural or legal person that remotely offers products and/or services to consumers. In this case, Gewoon JIP.

Consumer: the natural person not acting in professional or business purposes and who enters into a remote contract with the entrepreneur.

Applicability:

These general conditions apply to every offer of the entrepreneur and any reached distance agreement and contract between businesses and consumers.

Situations that are not covered by these terms and conditions,  are to be assessed ‘in the spirit’ of these general conditions. This also applies to uncertainties over the interpretation or content of provisions in these conditions.

Copyright:

All editions of Gewoon JIP., Both off and online are protected by copyright and image rights. The texts, illustrations and images of Gewoon JIP. and her team are copyrighted and owned by the entrepreneur. If you would like to use one of the texts or images, it is often possible, but please contact us first via info@gewoonjip.nl.

The offer:

The offer is non-binding. The entrepreneur is entitled to change the offer and adjust it.

All products are accompanied by a description. This is sufficiently detailed for the consumer to be able to make a good assessment of the product. The product images are a genuine reflection of the products offered.

All images, specifications and information in the offer are indicative and cannot be held as basis for damage claims or rescission of contract.

Each offer contains sufficient information, making clear to the consumer what rights and obligations are involved once the offer is accepted. Amongst other things:

The price includes all taxes
The cost of shipping depends on the size and the weight of the product.
The manner in which the agreement will be established.
The method of payment, delivery and performance of the contract.
The possibility, term and conditions of a return/refund.
Available sizes and colors of the products.

The agreement:

The agreement is concluded at the moment the consumer accepts the offer, provided that they comply with the corresponding conditions. The agreement is subject to the above under the heading of ‘Offer’.

The consumer is hereby to take the following steps: selection of desired product, add to shopping cart, fill address (both billing and delivery), check the order, select payment method, conclusion of payment.

The entrepreneur will confirm receipt of the contract electronically, by e-mail (info@gewoonjip.nl or mail@gewoonjip.nl). The entrepreneur creates a secure web environment and takes technical and organizational measures to protect the electronic transfer of data.

Right of withdrawal / Return:

When purchasing products, the consumer can terminate the contract without specifying a reason within 7 days. This period begins on the day following the receipt of the product by the consumer or a pre-designated third party of the consumer, within knowledge of the entrepreneur.

If the consumer wishes to exercise their right of withdrawal, they are required to submit their request to the entrepreneur within 7 days of receipt of the product.

If the consumer wishes to exercise their right of withdrawal, they are to cover the cost of the return shipping only. The entrepreneur will refund the cost of the product after receiving the returned item.

Exclusion of Right of Withdrawal / possibility of returning:

The entrepreneur can exclude the right of withdrawal of consumers for products that are clearly personal in nature. This entails tailor-made texts that have been devised and printed in accordance with the consumer.

Price:

During the period mentioned in the offer, product prices will not be increased, except for price changes due to changes in VAT rates.

The rates in the range of products are in Euros, include VAT and exclude shipping costs. The shipping costs are listed and added at a later step.

All prices are subject to misprints. No liability is accepted in case of an eventual misprint. The entrepreneur is not obliged to supply the product in accordance to the erroneous price.

Compliance and Warranty:

The entrepreneur guarantees that:

The products comply with the agreement;

The specifications stated in the offer comply with the reasonable requirements of reliability and / or usefulness;

And at the date of its conclusion, the agreement complies with existing legal provisions and / or government regulations.

Any defects or incorrectly delivered goods must be reported in writing to the entrepreneur within 7 days of delivery by e-mail info@gewoonjip.nl

The warranty does not apply if:

The consumer or a third party has repaired the product, or the product has been exposed to abnormal conditions or has been treated carelessly.

Delivery and execution:

The trader will take the greatest possible care when receiving and carrying out orders for products.

The place of delivery is the address that the consumer makes known to the company.

The company shall carry out accepted orders promptly (aim 3 to 5 days), no longer than 30 days, unless the consumer has agreed to a longer delivery period. If the delivery is delayed, the consumer will be informed. The consumer then has the right to terminate the agreement without penalty. The consumer is not entitled to compensation.

All delivery times are indications. The consumer does not reserve any right over mentioned time specifications. If a time limit is exceeded, the consumer is not entitled to any compensation.

In the event of termination of the agreement, the entrepreneur will provide a refund as soon as possible, and within no longer than 14 days. This, of course, only applies to Gewoon JIP. products purchased through gewoonjip.nl. If a product is purchased from a different outlet, returns will be arranged by that respective store.      

If delivery of an ordered product proves impossible, the entrepreneur shall make every effort to provide a replacement item. In case of a possible return, the entrepreneur will cover the cost.

The risk of damage or loss of products lies with the entrepreneur.

Payment:

Payment is to be made when the order is placed by using one of the payment methods listed and offered by the website.

The consumer has the duty to immediately report inaccuracies in data supplied or payment details to the entrepreneur.

In case of default of payment by the consumer, the entrepreneur, having informed the consumer beforehand and subject to statutory limitations, is entitled to charge the customer the reasonable costs incurred.

Complaints:

Complaints can be reported by e-mail or at the address listed.

Complaints must be made in full and clearly described, within 7 days of agreement with the entrepreneur.

The entrepreneur has 14 days to process the complaint and resolve it by mutual agreement.

If a complaint is accepted by the entrepreneur, the delivered products will be replaced free of charge, or repaired.

Intellectual property:

All product names, logos, models and designs, and the products of Gewoon JIP. are owned by the entrepreneur. Consumers shall respect the intellectual property of the entrepreneur and take this into consideration.

Disputes:

The agreement between the entrepreneur and the consumer, which these terms and conditions refer to, applies exclusively to Dutch law. Even if the consumer resides abroad.

Additional or different terms:

Additional or deviating terms and conditions may not be to the detriment of consumers and should be recorded in writing and/or stored in an accessible way to consumers.
